Agreement to Terms
By accessing or using eCards Photos (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
eCards Photos is operated by an individual sole proprietor based in Ontario, Canada. You must be at least 13 years old to use this Service.
Description of Service
eCards Photos is a digital greeting card platform that allows you to:
- Create digital greeting cards with photos and personalized messages
- Share cards via link with friends and family
- Download cards and photos for offline keeping
- Access premium features through a paid subscription
- Add business branding (logo and contact information) to cards with a Business subscription
User Accounts
You may use some features of the Service without an account. For full functionality, you may create an account by:
- Registering with your email address and password
- Signing in with Google
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

Acceptable Use Policy
You agree not to use the Service to create, upload, or share content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
- Contains explicit adult or sexual content
- Infringes on intellectual property rights of others
- Contains malware, viruses, or harmful code
- Impersonates another person or entity
- Violates the privacy of others
- Is spam or unsolicited advertising
We reserve the right to remove any content that violates these Terms and to terminate accounts of repeat offenders.
User Content
Your Ownership
You retain all ownership rights to the photos, messages, and other content you upload to the Service ("User Content").
License Grant
By uploading User Content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you and your card recipients.
Content Removal
We may remove User Content that violates these Terms. Cards and photos are automatically deleted after expiration (7 days for free tier, 90 days for Premium tier, 180 days for Business tier).
Business Branding
Business subscribers may upload a company logo and provide business contact information (company name, email, phone, and website) for display on their cards. By uploading a logo or providing business contact information, you represent and warrant that: (a) you own or have the right to use the logo and any associated trademarks; (b) displaying the logo and contact information on cards sent through the Service does not infringe on any intellectual property or other rights of third parties; (c) the business contact information you provide is accurate and current. Business branding (logo and contact information) is embedded in each card at the time of creation. Cards that have already been sent or downloaded will continue to display the branding that was active when the card was created, even if you later change your branding or cancel your subscription.

- AI Message Assistant (10/card, 50/day)
- Scheduled delivery
Business Tier - $9.99/month or $7.99/month billed yearly
- 3 GB storage
- 180-day card availability
- 1,500 downloads per card
- Business branding: company logo on cards
- Business contact info: name, email, phone, website on cards
- View count tracking for business cards
- 25 custom designs with HD images (up to 2000px)
- 5 images per side in the card designer
- All Premium features included (Signature video cards, voice messages, scheduling, protection, Sealed Cards)
Billing
Premium and Business subscriptions are billed through Stripe on a monthly or yearly basis. Your subscription will automatically renew unless cancelled before the renewal date.
Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain Premium or Business access until the end of your current billing period, after which your account will revert to the free tier.

Download Limits
To ensure card availability and prevent abuse, cards have download limits:
Once a card reaches its download limit, additional downloads will be blocked. Recipients who have already downloaded the card can continue to view their downloaded copy offline.
AI-Generated Content
AI Message Assistant
Premium subscribers have access to our AI Message Assistant, which generates greeting phrase suggestions using OpenAI's technology. This feature is subject to the following limits:
AI Content Disclaimer
AI-generated suggestions are provided as creative starting points only. You are responsible for reviewing and editing any AI-generated content before including it in your cards. We do not guarantee the accuracy, appropriateness, or suitability of AI-generated suggestions.
Prohibited Uses
You may not use the AI Message Assistant to generate content that violates our Acceptable Use Policy, including but not limited to harmful, abusive, or discriminatory content. We reserve the right to suspend AI access for users who abuse this feature.
Intellectual Property
The Service, including its design, features, and branding (excluding User Content), is owned by eCards Photos and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
Template designs and Signature card videos are provided for your personal or business use within the Service only. Business subscribers may display their own logos and trademarks on cards created through the Service, but this does not grant eCards Photos any rights to those logos or trademarks.
Business Subscription Terms
Logo Use and Intellectual Property
You are solely responsible for ensuring that any logo you upload does not infringe on the intellectual property rights of third parties, including trademarks, copyrights, or other proprietary rights. eCards Photos does not review uploaded logos for intellectual property compliance. We may remove logos that we believe, in our sole discretion, infringe on third-party rights or violate these Terms.
Business Contact Information Visibility
The business contact information you provide (company name, email, phone, and website) will be visible to anyone who views or downloads your cards. You are responsible for ensuring the accuracy of this information and for the consequences of displaying it publicly. eCards Photos is not responsible for how recipients use the contact information displayed on your cards.
Data Persistence After Cancellation
Business branding (logo and contact information) is embedded in each card at the time of creation. If you cancel your Business subscription or change your branding details, cards that were already created and sent will continue to display the original branding. New cards created after cancellation will not include business branding. Business logos stored in your account will be deleted when your subscription ends or when you delete your account, but copies embedded in previously sent cards will persist until those cards expire.
View Count Tracking
Business cards include view count tracking, which records the number of times a card is viewed. This data is stored in Firestore and visible to the card creator. View tracking does not collect personally identifiable information about viewers beyond what is described in our Privacy Policy.
Individual Accounts Only
Each Business subscription is tied to a single individual account. Business subscriptions do not include team or multi-user access. Sharing account credentials is not permitted.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECARD PHOTOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless eCards Photos from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Ontario, Canada.
Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
